Index Publication autorisée par le jury Thèse doctorat Droit privé Cergy-Pontoise 2003 L'adoption d'une directive communautaire portant création d'une garantie de l'acheteur/consommateur a relancé le débat sur la réforme de la garantie des vices cachés. Deux types de transposition du texte européen ont été proposés : en premier lieu, une transposition a minima de la directive dans le Code de la consommation a été envisagée ; en second lieu, une réforme de fond du Code civil par l'unification de l'action en garantie des vices cachés et de l'action pour délivrance non conforme. Après avoir réalisé un état des lieux du droit positif et des droits étrangers, puis après avoir recherché si la distinction entre les deux principales obligations du vendeur pouvait être supprimée, des pistes de solution sont proposées. Il s'agirait d'une solution médiane visant à transposer la directive dans le Code de la consommation tout en procédant à une réforme partielle du droit de la vente. Seuls les points les plus problématiques seraient modifiés (délais) mais en contrepartie, il faudrait s'attacher à rationaliser le droit par l'élaboration, notamment, de critères efficaces de distinction entre les actions. Une modification approfondie ne pourrait être envisagée qu'après une réflexion d'ensemble des Etats de l'Union Européenne. With the EC directive that created the guarantee of the buyer-consumer, the reform of the guarantee from hidden defects is in the centre of the discussions. Two possibilities of the incorporation of the European text into the French legislation are proposed : according to the first possibility, the directive must be incorporated a minima into the French Consumer Code. The other possibility is to drastically reform the Civil Code by unifying the guarantee and the the obligation to deliver the agreed-upon goods. After the analysis of the state of jurisprudence as well as the foreign legislation on the issue, and a study of the possibility of the abandon of the distinction between the two principal obligations of the vendor, certain solutions have been proposed. They consist in the incorporation of the directive into the Consumer Code and a partial reform of the sales legislation. Only the most problematic points will be modified and in return, the terms of the sale laws have been rationalised by elaboration of efficient criteria of the distinction between different actions. A more substantial reform of the Civil Code can be expected in the future after a serious analysis on the part of the Members of the EC.
