D'une nature philosophique, le concept d'atteinte à la dignité de la personne humaine tend à accéder au statut de concept juridique. Le Code pénal de 1994 a créé une nouvelle catégorie d'infractions contre les personnes. Au Livre II, Titre II, le Chapitre V " Des atteintes à la dignité de la personne " vise la discrimination, le proxénétisme, les conditions de travail et d'hébergement contraires à la dignité de la personne, le bizutage et les atteintes au respect dû aux morts. Notre analyse critique remet en cause le contenu de cette catégorie pénale. Pour critiquer son contenu, il faut d'abord tenter d'élaborer une définition pénale du concept d'atteinte à la dignité de la personne. Sur le fondement de cette définition, il convient d'étudier les infractions de la catégorie et d'en déduire si elles correspondent aux critères de l'atteinte à la dignité de la personne. Ainsi, le contenu actuel de la catégorie n'est pas cohérent : certaines infractions devraient en être exclues et d'autres devraient y être intégrées. Il convient de modifier le contenu de la catégorie pénale. Egalement, il est nécessaire de s'interroger sur la notion de catégorie. La catégorie pénale est-elle la meilleure technique d'introduction du concept ? Ne faudrait-il pas envisager la création d'une nouvelle catégorie pénale visant les atteintes à la dignité de l'espèce humaine ? L'introduction d'un principe général du droit pénal de dignité de la personne pourrait être le moyen d'appréhender des actes qui ne sont pas rattachés aux atteintes à la dignité mais qui se révèlent indignes au regard des caractéristiques de la victime ou de l'auteur de l'acte. Ce nouveau principe général élargirait le rôle du juge et les droits de la victime. Finalement, de l'élaboration d'une définition du concept pénal d'atteinte à la dignité de la personne, nous parvenons à la création d'une seconde catégorie pénale protégeant la dignité de l'espèce humaine et à l'insertion d'un nouveau principe général du droit pénal de dignité de la personne. Cette analyse critique remet en cause le contenu actuel de la catégorie pénale des infractions d'atteinte à la dignité de la personne mais aussi la classification actuelle des infractions du Code pénal.

Of a philosophic nature, the concept of infringement on the dignity of the human person tends to reach the status of legal concept. The Penal code of 1994 created a new category of malpractices against the persons. In the Book II, Title II, Chapter V " infringements on the dignity of the person " aims at discrimination, at procuring, at the opposite conditions of employment and residence at the dignity of the person, the ragging and the infringements on the respect due to the deaths. Our critical analysis questions the contents of this penal category. To criticize the contents, it is necessary at first to try to elaborate a penal definition of the concept of infringement on the dignity of the person. On the foundation of this definition, it is advisable to study the malpractices of the category and to deduct from it if they correspond to the criteria of the infringement on the dignity of the person. So, the current contents of the category are not coherent: Certain malpractices should be it exclude and the others must be integrated into it. It is advisable to modify the contents of the penal category. Also, it is necessary to wonder about the notion of category. Is the penal category the best technique of introduction of the concept? Would not it be necessary to envisage the creation of a new penal category aiming at infringements on the dignity of human race? The introduction of a general principle of the criminal law of dignity of the person could be the means to arrest(dread) acts which are not connected with infringements on the dignity but which show themselves despicable towards the characteristics of the victim or the author of the act. This new general principle would widen the role of the judge and the rights of the victim. Finally, from the elaboration of a definition of the penal concept of infringement to the dignity of the person, we reach the creation of a second penal category protecting the dignity of human race and in the insertion of a new general principle of the criminal law of dignity of the person. This critical analysis questions the current contents of the penal category of the malpractices of infringement on the dignity of the person but also the current classification of the malpractices of the Penal code.
